Email Marketing & the Law Diagram

Do you intend to send out emails to market your business? Well there is a law behind it that you must follow for it to be legal. Below is a summary of the rules:

1. When you send marketing emails your identity must be clear, and you must give a valid address for opt-out requests.
2. You can’t send the e mail marketing campaigns unless you have the approval / consent from the receiver for the same.
3. The above ‘opt-in’ rules are relaxed if the following exemption criteria are satisfied:

• The e mail address was collected ‘in the course of a sale or negotiations for a sale’;
• The sender only sends promotional messages relating to their ‘similar products and services’
• When the mail id was collected, an option was given to opt out (free of charge except for the cost of transmission) which you didn’t take. The opportunity to opt-out must be given with every subsequent message.
